NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />1. That on September 7, 2000, A1 Kempf, hereinafter referred to as "Applicant", properly <br /> applied for a conditional use permit to exceed the front yard fence height restrictions. <br /> <br />o <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />That the Applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on October 3, 2000, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />That the Subject Property and surrounding parcels are zoned R.-1 Residential, except that the <br />adjacent parcel to the north is zoned B-1 Business. <br /> <br />That the Subject Property is located in the Metropolitan Urban Service Area. <br /> <br />That the Subject Property is' approximately 1.4 acres in size. <br /> <br />That Section 9.20.1.2 of the Ramsey City Code states that only decorative fences are alIowed <br />in the front yard and they shall not exceed forty-eight (48) inches in height. <br /> <br />That the Applicant is requesting permission to erect a 6 foot high wood, privacy fence in the <br />front yard to mitigate the loss of mature trees in the T.H. #47 improvement project that <br />previously provided a visual and audio buffer to the traffic. <br /> <br />That in order to save the remaining trees along the front property line, the .Applicant is also <br />proposing to locate the fence approximately 2 to 3 feet into the T.H. #47 right-of-way. <br /> <br />That the Applicant must obtain a permit from Mn/DOT to locate the fence within the T.H. <br />#47 right, of-way. <br /> <br />That the proposed use will not adversely impact traffic in the area. <br /> <br />That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br />That the proposed use will not substantially adversely impair the use, enjoyment, or market <br />value of any surrounding property. <br /> <br />That the proposed use will not be hazardous or disturbing to existing or future neighboring <br /> <br />uses. <br /> <br />That the proposed use will not create excessive additional requirements at public cost for <br />public facilities and services, and it will/will not be detrimental to the economic welfare of <br />the community. <br /> <br />RESOLUTION #00-10- <br />Page 2 of 3 <br /> <br />-139- <br /> <br /> <br />
