Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #00-10- A RESOLUTION APPROVING THE' ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT FOR PRIVATE DOG KENNEL TO MAINTAIN MORE THAN TWO DOGS ON A PARCEL OF LAND. WHEREAS, the Ramsey City Council adopted Resolution #00-10-' adopting Findings of Fact #~ to maintain more than two (2) dogs on a parcel and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On , a Conditional Use Permit ("Permit") was issued by the City of Ramsey ("City") to Amy Ross ("Permittee") for a private dog kennel to maintain more than two adult dogs on the property generally known as 8100 154~ Avenue and legally described as follows: Lot 4, Block 12, Whispering Pines Estates, Anoka County, Minnesota ("Subject Property"). This Permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this Permit are as follows: 1. This Permit shall remain in effect so long as the conditions imposed herein are complied with. 2. This Permit shall allow for the maintenance of a maximum of six (6) adult dogs on the Subject Property and an adult dog is defined as any dog over three (3) months of age. The Permittee agrees that nb more than four (4) dogs can be kenneled outside at any one time, except that all six (6) dogs may be exercised outside under the owners control during the hours of 7:00am- 8:00pm. 4. The Permittee agrees that all six (6) dogs will be kenneled indoors by 8:.00pm every evening. Upon confirmation of any complaints of odor or noise problems relating to the dogs, the City may take action to abate the nuisance in accordance with Section 5.09.03 (Dog Regulations), subd. 18. (Dogs Disturbing the Peace), of the Ramsey City Code, attached hereto as Exhibit A. .161-
