JOINT POWERS AGREEMENT <br /> <br /> THIS AGREEMENT entered into as of the date of execution by and between the County <br />of Anoka, a Minnesota municipal corporation (hereafter "County"), the City of Ramsey, a <br />Minnesota muaicipal corporation, and the Lower Rum River Watershed Management Organization, <br />a joint powers entity (hereafter the "Commission") created by the City of Andover, the City of <br />Anoka, the City of Coon Rapids, and the City of Ramsey. <br /> <br /> WHEREAS, the parties to this Agreement have authority pursuant to Minnesota Statutes, <br />Section 471.59, to jointly and cooperatively by agreement exercise any powers common to the <br />contracting bodies pursuant to Minnesota Statutes; and <br /> <br /> WHEREAS, Minnesota Statutes, Section 103D.625 provides a procedure for County Ditch <br />Systems to be transferred for maintenance by the County to a local watershed district or watershed <br />management organization; and <br /> <br /> WHEREAS, the members of the Commission authorize and agree to accept that portion of <br />County Ditch No. 43 and County Ditch No. 3 aJk/a County Ditch No. 66 for maintenance which lies <br />within the City of Ramsey on the condition that the City of Ramsey will maintain this County Ditch <br />System as a part of its general municipal improvements and in a fashion consistent with the <br />Commission's approved watershed management plan; and <br /> <br />WHEREAS, the City of Ramsey is one of the members of the Commission. <br /> <br />NOW, THEREFORE, the parties to this Agreement do mutually agree as follows: <br /> <br /> SECTION 1 <br />PURPOSE AND INTENT <br /> <br /> 1.1. The City of Ran~sey has determined that it is necessary and expedient, in the interest <br />of'the citizens of that city, and consistent with sound surface water management practices that <br />certain ditches, which are described above, that were originally created as county ditches should <br />continue to be used to divert and channel surface waters. <br /> <br /> 1.2. The area drained by these ditches has become urbanized since the establishment of <br />the ditches. These changes in land use patterns have rendered it impractical for the current ditch <br />authority, Anoka County, to repair, maintain or operate these ditches because of legal limitations in <br />state laws relating to county ditches. <br /> <br /> 1.3. Minnesota Statutes Sections 103D.625 and 103B.211, Subd. 1, authorize the transfer <br />of county ditches to watershed districts and joint powers watershed management organizations such <br />as the Commission. <br /> <br /> 1.4.
