PARK DEDICATION <br /> <br />12. <br /> <br />ao <br /> <br />13. <br /> <br />a) <br /> <br />b) <br /> <br />The Plat is located in the Sunfish Lake Park District. Park dedication <br />requirements shall be satisfied by a cash payment in the amount of $112,800.00 <br />(94 units x $1,200 per un/t). <br /> <br />PEDESTRIAN TRANSPORTATION <br /> <br />Trail Development Fee. The City Council has enacted a trail development fee in <br />the amount of Three Hundred Dollars and no cents ($300.00) per lot. Therefore a <br />payment in the amount of Twenty Eight Thousand Two Hundred Dollars and no <br />cents ($28,200.00) (94 lots x $300/lo0 is due at the City prior to releasing the <br />Final Plat for recording. This trail development fee shall be credited in the <br />amount of Seventeen Thousand Dollars and no cents ($17,000.00) for trail <br />construction described in Item c below. The net amount of trail development fees <br />due at the City is Eleven Thousand Two Hundred Dollars and no cents <br />($11,2oo.oo). <br /> <br />Sidewalk Construction. The DEVELOPER shall construct and pave, in <br />accordance with CITY standards, a five (5) foot wide concrete sidewalk, not to <br />exceed 5% in grade, parallel to and on the south side of 140t~ Avenue N.W., <br />continuing west to the intersection with Dysprosium Street N.W. This sidewalk <br />construction is not park dedication credit eligible. <br /> <br />Trail Construction. The DEVELOPER shall construct an eight (8) foot wide <br />bituminous trail, not to exceed 5% in grade, on the east side of Dysprosium Street <br />N.W., from 140~ Avenue N.W., south to County Road #116, then continuing <br />along the north side of County Road #116, east to the intersection of County Road <br />#116 and T.H. #47. The CITY shall assist the DEVELOPER in obtaining right- <br />of-way or easements to facilitate the trail alignment. The trail construction shall <br />be Trail Development Fee credit eligible at a rate of $8.50/lineal foot. This <br />segment of trail is estimated to be 2,000 feet in length, which results in a trail <br />development fee credit of Seventeen Thousand Dollars and no cents ($17,000.00). <br /> <br />LANDSCAPING <br /> <br />New Plantings. Trees, shrubs and turf shall be installed in accordance with the <br />approved Site and Landscape Plan. <br /> <br />Construction Damage. It is herein agreed that the DEVELOPER shall minimize <br />the impact of construction on existing trees in accordance with Minnesota Extension <br />Service Publication "Protecting Trees From Construction Damage" (Publication <br />~NR-FO-6135-s), <br /> <br />-243- <br /> <br /> <br />
