Motion by Councilmember Flendriksen and seconded by Councilmember Cormolly to direct <br />Staff to draft findings of fact in the negative as it relates to the request from TSM Development, <br />Inc. for an exception to the development moratorium. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Connolly, Anderson, <br />and Zimmerman. Voting No: None. Absent: None. <br /> <br />Mr. Wallrich asked when the Comprehensive Plan will be back from the Metropolitan Council <br />and under consideration by the Council. <br /> <br />Community Development Director Frolik stated the official 60 day "clock" with the <br />Metropolitan Council has not yet been started for the Metropolitan Council review. <br /> <br />City Manager Norman explained the Metropolitan Council considers the Plan to be incomplete <br />so the "clock" has not yet started. <br /> <br />Case #4: <br /> <br />Request for a Conditional Use Permit for a Personal Communication Service <br />Tower; Case of U.S. West Wireless <br /> ? <br /> <br />This item was considered earlier in the meeting. <br /> <br />Case #5: Proposed Ordinance to Amend Size Limits on Attached Garage <br /> <br />Community Development Director Frolik stated that 1999 was the last time the City Code <br />regulations regarding garages and accessory buildings were amended. At that time, City Staff <br />decided to include a size restriction of 1,000 square feet on attached garages. The Planning <br />Commission held a public hearing regarding the proposed ordinance to eliminate size restrictions <br />on attached garages dnring which no verbal or written comments were submitted. The Planning <br />Commission and Staff recommended adoption of the ordinance. <br /> <br />Councilmember Hendriksen asked which section of the ordinance prohibits the garage from <br />being larger than the size of the house. <br /> <br />Community Development Director Frolik stated nothing prohibits constructing an attached <br />garage that exceeds the height of the house. <br /> <br />Councilmember Hendriksen stated that by virtue of the minimum house size and maximum <br />garage size, a garage of a substantial size has not been an issue. <br /> <br />Community Development Director Frolik noted the current regulation has been on the books for <br />ten months and the Building Official has indicated it has caused more problems than it has <br />solved. <br /> <br />City Council/April 11, 2000 <br /> Page 20 of 27 <br /> <br />-90- <br /> <br /> <br />
