<br />~ <br /> <br />REC'O OCT 21 2008 <br /> <br />111111111111111111111111111111111111111111111 <br />Record 102147406 <br /> <br />Board Member Brauer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #08-09-168 <br /> <br />0' <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CHAD AND <br />MELODIE STORBAKKEN AT 16021 OSMIUM STREET NW (PERMITTEES) FOR <br />ACCESSORY STRUCTURE SIDEWALL HEIGHT RESTRICTIONS AND <br />DECLARING TERMS OF SAME <br /> <br />WHEREAS, Chad & Melodie Storbakken (Permittees) have properly applied for a <br />variance from Section 9.11.02 (Accessory Uses & Buildings) of the Ramsey City Code for the <br />sidewall height of an. accessory building on the property generally known as 16021 Osmium St <br />NW and legally described as follows: <br /> <br />Lot 2, Block 7, Hall-Anderson Acres, subject to easement as shown on the plat, (subject <br />to easement grant 4-2-74), Anoka County, Minnesota <br /> <br />(Subject Property). <br /> <br />AND WHEREAS, the Board of Adjustment conducted a public hearing on September 4, <br />2008, pursuant to Section 9.03.07 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That based on Findings of Fact #0829 a variance to the sidewall height restriction of an <br />accessory building on the Subject Property is hereby granted. <br /> <br />2. That the sidewall height of the accessory building shall not exceed thirteen and a half (13.5) <br />feet. <br /> <br />3. That no other structure or addition shall be constructed unless it is in accordance with City <br />Code. <br /> <br />4. That the Permittees shall be responsible for all costs incurred in administering and enforcing <br />this variance. <br /> <br />5. That the Permittees shall obtain all necessary permits prior to commencing any construction <br />of the accessory building. <br /> <br />6. That the accessory building shall be used for storage of personal property and that no <br />commercial activity of any type shall be permitted in said structure unless it is in accordance <br />with City Code. <br /> <br />7. That the Permittees agree that the terms of this Variance shall be binding upon its successors <br />and assigns. <br /> <br />2003252. 002 <br />
