CASE # a

PUBLIC HEARING: CONSIDER INCREASING
OFF-SALE INTOXICATING LIQUOR LICENSE FEE
By: Jo Thieling, City Clerk

Background:

In 2007, the State of Minnesota increased the amount cities were allowed to charge for an off-
sale liquor license from $200 per year to $370 per year. The City of Ramsey didnot increase the
fee in 2007 or 2008. Staff is asking Council to consider an increase of $90 for license year
2009/2010 and the additional $90 for 2010/2011. (The renewal time for liquor licenses is July 1.)

There are certain conditions set forth by the State that would allow the licensee to be refunded
$100 by the City. Those conditions are spelled out in the State Statute (attached). Council will
recall that in July of this year, an ordinance (also attached) was adopted which would allow an .
additional $100 be deducted from an off-sale establishment's annual fee if they purchase and
utilize electronic age vertification technology. If the off-sale liquor establishment met all these
. conditions, the total for their license would be $90 for 2009/2010 and $190 for. year 2010/2011.
Even with a fee increase, the total cost for the license could potentially be less than the current
fee.

State Statutes regulates that a liquor license fee be increased only after a public hearing has been
held. Statute also rules that all affected licenseses be mailed notice of the proposed increase at
least 30 days in advance of the hearing. The public hearing was noticedin the Anoka County
Union and alllicensess were mailed a letter informing them of the public hearing.

Attachments:
1) Copy of Minnesota Statutes 340AA08 Retail License Fees
2) Public Hearing Notice
3) Ordinance #08-23
4) Copy of Notice Letter Mailed to Licensees

Funding:

No funding is required.

Council Action:

Motion to increase/not increase the fee for the Off-Sale Intoxicating Liquor License to $290 for
license year 2009/2010 and to $380 for license year 2010/2011.

Reviewed by:

City Clerk
Police Chief
Financer Officer
City Administrator:

C-\
/.-/'"' . .
