<br />Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #08-10-_ <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OFA CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT #_AND DECLARING TERMS OF PERMIT AND <br />TO EXCEED SIGN RESTRICTIONS AS ESTABLISHED IN CITY CODE. ' <br /> <br />WHEREAS, A-I Custom Signs properly applied for a conditional use permit to exceed <br />sign size and number restrictions as established in City Code on the property generally known as <br />940 1 Highway 10 NW and legally described as follows: <br /> <br />Lot 2, Block I, Sunfish Commons, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br />WHEREAS, the Planning Commission met on October 2, 2008, conducted a public <br />hearing, and recommended that City Council approve the request. <br /> <br />NOW THEREFORE, BE JT RESOLVED BY TIDS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Based on Findings of Fact # -' a conditional use permit ("Permit") to exceed sign size and <br />number restrictions is hereby granted to A-I Custom Signs ("Permittee"). <br /> <br />2. The Permittee is herein granted permission to erect one directional, ground sign in addition <br />to the existing ground sign used to advertise the tenants of the facility, on the Subject <br />Property. <br /> <br />3. The gross' surface area of the free standing,. directional ground sign shall not exceed 16. <br />square feet per face per sign. <br /> <br />4. The installation of the signs on the Subject Property shall require a sign permit from the <br />City of Ramsey (the "City"). The exact location, height, and configuration of the signs are <br />subject to the approval of the City. Footings for each sign must be sized by a licensed <br />engineer. <br /> <br />5. The signs shall be properly constructed and maintained in accordance with Section 9.12.12 <br />(Construction Specifications) & 9.20.12 (Signs) of the Ramsey City Code. <br /> <br />6. That the Permittee shall be responsible for all City costs incurred in adririnistering and <br />, enforcing, this Permit: <br /> <br />~ <br /> <br />7. That the City Administrator, or his/her designee, shall have the right to inspect the premises <br />for compliance and safety purposes annually or at any time, upon reasonable request. <br /> <br />8. That if any provision of this Permit shall be declared void or unenforceable, the other <br />provisions shall not be affected but shall remain in full force and effect. <br /> <br />-147- <br />
