Absent: Commissioners Brauer and Levine. <br /> <br />NOTE CITY COUNCIL MINUTES <br /> <br />The following Council minutes were noted: <br /> <br />1) City Council regular meeting minutes dated August 26, 2008 <br />2) City Council regular meeting minutes dated September 8, 2008 <br /> <br />Commissioner VanScoy noted the discussion by the. City Council regarding when a <br />Councilmember should abstain from a vote due to a conflict of interest and requested direction <br />. from staff regarding whether this discussion applies to the Planning Commission members. <br /> <br />Community Development Director Miller stated she would get back to the Planning Commission <br />regarding this. <br /> <br />PUBLIC HEARINGS/COMMISSION BUSINESS <br /> <br />Case #1: <br /> <br />Public Hearing - Request for an Interim Use Permit to Allow for the <br />Operation of a Church in the B-1 Business District; Case of Rum River <br />Retail Ventures, LLC <br /> <br />Chairperson Nixt closed the regular portion of the Planping Commission meeting at 7:03 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 7:03 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Miller explained the City has received an application for an <br />Interim Use Permit from Rum River Retail Ventures to allow for the temporary operation of a <br />church facility in an area zoned B-1 Business District. She indicated the temporary church <br />facility will be in a multi-tenant building located at 6008 167th Ave NW and the Applicant would <br />like to be able to utilize the space for church offices, Sunday. services and to provide other <br />services, such as youth group meetings/activities, throughout the week. <br /> <br />Commissioner Brauer arrived at 7:04 p.m. <br /> <br />Community Development Director Miller stated the applicant is requesting that the duration of <br />the Interim Use Permit be five years, which is the maximum allowable time permitted by City <br />Code; following further discussion with the Fire Chief, staff is recommending that the Interim <br />Use Perm.it be granted for a period of three years, as evidenced by the amended Resolution.
