<br />Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #08-11-_ <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #_ RELATING TO A <br />REQUEST FROM GENE AND CINDY GOEDE FOR A HOME OCCUP AJ'ION PERMIT <br />TO OPERATE A TREE SERVICE BUSINESS. ON THE PROPERTY LOCATED AT <br />17725 BAUGH ST NW; <br /> <br />WHEREAS, the City of Ramsey received an application from Gene and Cindy Goede <br />requesting a home occupation permit to operate a tree service business in a principle dwelling. <br />unit and accessory structure located on the property generally known as 17725 Baugh St NW and <br />legally described as follows: <br /> <br />The south 495 feet of the west880 feet of the Southwest Quarter of the Northeast Quarter <br />of Section 6, Township 32, Range 25, Anoka County, Minnesota as measured at right <br />angles to the south ~d west lines thereof (subject to County Road No. 83 Baugh Street) <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY TillS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be asfoII9wS: <br /> <br />1. That on October 28,2008, Gene and Cindy Goede; hereinafter referred to as "Applicant", <br />properly applied for a principle dwelling and accessory structure home occupation permit <br />(the "Permit") to operate a tree service on the Subject Property. <br /> <br />2. That businesses operating within a principle dwelling or accessory structure in the R-l <br />Residential District require the issuance of a home occupation permit. . <br /> <br />3~ That on June 16,2008, the City Council adopted a home occupation ordinance allowing <br />residents the ability to apply for a home occupation permit to operate a business within an <br />. accessory structure and employ non-resident employees as outlined in the home <br />occupation ordinance. <br /> <br />4. That the Applicant has stated that the business has been operating for several years on. <br />the Subject Property. <br /> <br />5. That the City has not received any ordinance complaints regarding the operation of the <br />home occupation on the Subject Property. . <br /> <br />6. That the Applicant appeared before the Ramsey Planning Commission for a public <br />hearing pursuant to Section 9.03.05 of the City Code on November 6,2008, and that said <br />public hearing was properly advertised. <br /> <br />7. That the Subject Property is' zoned R-l Residential - Rural Developing, and the' <br />surrounding parcels are also zoned R-l Residential- Rural Developing. <br /> <br />8. That the Subject Property is approximately 9.3 acres. <br /> <br />33 <br />
