Pursuant to the standards specified in <br />~he town's zoning by-laws, Cornell's property lacked sufficient frontage <br />for more than one lot. Hoping to subdivide the property into two lots, <br />Cornell applied to the town for a variance. In March 2002, the town's <br />board of appeals granted Cornell a variance to subdivide his parcel into <br />two lots. <br />Thereafter, Cornell began to seek the necessary approvals from other <br />town boards to subdivide and develop his property. After hiring a land <br />" surveyor to finalize his development plan, he sought an "approval not <br />required" endorsement from the town planning board. He received that <br />approval on August 14,2002.
