She asked the Fire Chief if he was comfortable with
the 36-month term of the permit.

Fire Chief Kapler stated his preference would have been for 12 months, however, he indicated he
is reasonably comfortable with the length of the permit. He added the fire safety measures will
be strictly enforced by the City.

Commissioner Brauer stated the close proximity of the fire hydrant to the building will allow for
faster response in the event of a fire.

Motion carried. Voting Yes: Chairperson Nixt, Commissioners Brauer, Hunt, Rogers, and Van
Scoy. Voting No: Commissioner Cleveland. He indicated in accordance with City Code, all variations to the sign
regulations are processed with the conditional use permit application. He explained there is
currently a large road construction project on Sunfish Lake Boulevard that is impacting traffic
patterns in the area; as a result, the applicant has approached the Economic Development
Authority for assistance with signs letting drivers know how to access Sunfish Commons. He
added there are two separate signs shown in the packet, .but the request this evening relates only
to the illuminated signs, which exceed the sign restrictions in the City Code. He explained the
applicant is proposing directional signs that are 16 square feet in size at a height of 7'9". He
stated staff has had an opportunity to meet with the applicant to discuss placement of the signs

Planning Commission/October 2, 2008
