Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #08- 11 -___ A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A REQUEST FROM KARIANNE OLSON FOR A CONDITIONAL USE PERMIT FOR A PRIVATE DOG KENNEL TO MAINTAIN A MAXIMUM OF FOUR DOGS ON A PARCEL OF PROPERTY GENERALLY LOCATED AT 6250 160 LANE NW. WHEREAS, the City of Ramsey received an application from Karianne Olson for a conditional use permit to maintain a maximum of four (4) dogs on the property generally known as 6250 160 Lane NW, and legally described as follows: Lots 4,4A,4B,5A BLK 1 Oakwood Hills, Together with Tract A Registered Land Survey No. 193, Subject to Easement Of Record, of Anoka County, Minnesota. — (the "Subject Property"). NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: 1. That City Code Section 5.09.03, subd.2. allows no more than three (3) dogs per parcel as a permitted use. Four (4) or more dogs requires the issuance of a conditional use permit 2. That on October 2, 2008 Karianne Olson, hereinafter referred to as the "Applicant ", properly applied for a conditional use permit for a private dog kennel to maintain four or more dogs on the Subject Property. 3. That the Subject Property is zoned R -1 Rural Developing. 4. That the adjacent properties are also zoned R -1 Rural Developing. 5. That the Subject Property is approximately 2.72 acres in size. 6. That Section 5.09.03, subd.l. of the Ramsey City Code defines private dog kennels as any place where four or more dogs over six (6) months of age are kept on property occupied by the dog owner for residential purposes and where the keeping of such dogs is incidental to the occupancy of the premises, and may include breeding and selling dogs as a hobby. 7. That private kennels for four or more dogs are a conditional use per City Code Section 9.20.11, subd.3. 8. That the Applicant is proposing to maintain four (4) dogs, on the Subject Property. 9. That the Applicant has stated that the dogs residing on the Subject Property consist of two (2) Chihuahuas, one (1) American Bulldog, and one (1) Black Labrador Retriever.
