~ ~5 <br />CASE #: Consent Agenda <br />FIREFIGHTER DECLARATION OF A DUAL POSITION <br />By: Givonna Reed Kone, Human Resources Manager <br />Background <br />Minnesota Statute 353.63 gives special consideration to firefighters who are required to <br />perform hazardous work and who devote their time and skills to protecting the property <br />and personal safety of others. Before PERA will allow a dual position membership in the <br />Police and Fire Plan, the City Council must certify by resolution that the dual position has <br />fire fighting as its primary duty and other related tasks (i.e, fire inspections) as secondary <br />duties. In addition, the following eligibility requirements must be met: <br />• The individual must hold a Firefighter I or II state certification, and <br />• Must be dispatched to fire calls and expected to respond as a firefighter on a <br />regular basis. The emergency response duty must have a recurring nature and <br />responding to the call must be the highest priority once dispatched to the scene. <br />• All day time hours (or full-time hours) are used to earn PERA service credits and <br />those same hours may not be used to earn Fire Relief Association service credits. <br />Staff has conferred with the Fire Chief and he has confirmed that Mr. Kohner has met the <br />first two requirements listed above. Mr. Kohner began working for the City full-time on <br />September 8, 2008 and has not yet completed a full quarter. Staff is confident that <br />Mr. Kohner can and will meet the third eligibility requirement; however, we will not be <br />able to confirm this until the fourth quarter payroll is completed. for volunteer firefighters. <br />Staff recommends that the City Council certify to PERA that Matt Kohner meets the <br />eligibility requirements. for membership in the PERA Police and Fire Plan. <br />Funding Source <br />The City's contribution to the PERA Police and Fire Plan on behalf of Mr. Kohner would <br />be-14.1 % of gross wages for 2009. These funds have been included in the 2009 General <br />Fund Budget. <br />Committee Recommendation <br />Make a motion recommending that the City Council certify to PERA that Matt Kohner is <br />eligible for membership in the PERA Police and Fire Plan. <br />Reviewed By: <br />,Reviewed By: <br />Administrator <br />Chief <br />-131- <br />
