He was told he'd have to go through site plan approval, public hearing, go back to the <br />Planning and Zoning Commission, etc. He stated the buyer wanted the purchase agreement signed <br />by February 15, 1991. He added that if he can't give the buyer the idea of final plat approval, the <br />buyer will no longer be interested in the property. He added that all the necessary steps were taken <br />for the preliminary plat approval and now he's appearing before City Council requesting final plat <br />approval. <br /> <br />Discussion ensued with regard to what Mr. Raudio needs to present for final plat approval. Mayor <br />Gilbertson asked City Engineer Jankowski if he could see any problems with the final plat <br />approval if Mr. Raudio completes the requested items. Mr. Jankowski stated he couldn't see a <br />problem and asked if Council was willing to relinquish final plat approval authority to City Staff. <br />Councilmember Hardin inquired if City Attorney Goodrich was comfortable with the approval to <br />which Mr. Goodrich answered that he was. Mr. Jankowski asked Mr. Raudio if he still plans <br />three driveway accesses on to County Road gl 16..He added that there is normally a time duration <br />on preliminary plats because things change. He also said that the ordinance states the City does not <br />permit access on to arterials and thoroughfares and it would be desirable to limit or eliminate access <br />on to County Road gl 16. Mr. Raudio stated that everything is the same as on the preliminary plat <br />approval. Mr. Goodrich asked if City Council wanted to change the accesses on to County Road <br />gl 16. Mr. Jankowski stated that the alternates could be that four lots could access to Dysprosium <br />and reduce it to two accessing on to County Road #116. Mr. Raudio stated he was not opposed if <br />that would be the best way to go. Mayor Gilbertson commented that it would be nice to have the <br />subdivision completed. Mr. Norm Holm commented that with regard to the driveway discussion, <br />MSA wouldn't supply funding unless there were less accesses onto Dysprosium Street N.W. He <br />stated that the phm was submitted to the County and they were okay with the driveways accessing <br />on to County Road gl 16. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Peterson to approve the final <br />plat of Flintwood Hills 5th Addition contingent upon the following: 1) Developer meeting all <br />terms and conditions of the City's zoning code and subdivision code; 2) Developer entering in to a <br />development agreement with the City; 3) Developer paying required City administrative escrow <br />payment; 4) Developer depositing with the City the required improvement escrow payment based <br />on the City Engineer's estimate of cost of construction of the plat improvement; 5) Developer <br />providing to the City proof of marketability title; 6) City Attorney determining that the proper legal <br />requirements have been met for the City returning the present easement across the property back to <br />the developer; and 7) approval by the City Engineer. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Beyer, Peterson, Cich and <br />Hardin. Schleper, et. al. which is a condemnation action <br />concerning acquisition of right-of-way for 153rd Avenue N.W. and is pending in Anoka <br />County District Court as District Court File #02-C8-90-6612; and <br /> <br />Steve Blakemore versus the City of Ramsey which is a special assessment appeal - <br />Improvement Project #89-15 in which case is presently pending in Anoka County District <br /> <br />City Council/February 12, 1991 <br /> Page 11 of 12 <br /> <br /> <br />
