This permit had no set completion
date and was to remain in effect so long as the permit conditions were met. Subsequently, major
revisions to the Code regarding mining and grading were enacted, making certain conditions more
restrictive than the previous ordinance. North Fork, Inc. has requested that the 1987 permit be
reissued to meet the requirements of the current ordinance. Mr. Jankowski summarized the terms
of the conditional use permit. Item #11 should be amended to read "Dewatering is specifically
prohibited within the scope of this conditional use permit unless additional submittals are mandated
and approved by the City Engineer".

Motion by Councilmember Peterson and seconded by Councilmember Beyer to adopt Resolution
#91-04-091 approving the conditional use permit request for grading and excavating; Case of
Glenn Rehbein Excavating, Inc. and North Fork, Inc.

Motion carried.
