Case #12: Issues Relating to Outlot B, Countryside Estates <br /> <br />Attorney Goodrich stated that Countryside Estates was platted and accepted by the "Township of <br />Ramsey" in 1972. When the actual plat was recorded, it did not reflect the dedicated use of outlots <br />which resulted in a home being constructed on what should have been parkland. In 1989, the City <br />Council recognized the problem and received comment from several Countryside Estate residents. <br />Their main concern was the loss of park area for the children. In response to this, the City <br />purchased a three acre tract in the adjacent Windsorwood Plat to be used as a park. Wright Title <br />Company in Elk River issued the title policy to Chateau Construction for the home on the subject <br />property and are most interested in cleaning up the title problems relating to this lot. They are <br />willing to pay the City $1,000.00 towards expenses in vacating the City's park interests in the <br />north half of the lot. Mr. Goodrich stated that the only practical way to resolve this issue is for the <br />City to vacate the north half of the lot on which the home has been constructed. <br /> <br />Motion by Councilmember Hardin and seconded by Councilmember Beyer to direct City Staff to <br />prepare the appropriate legal documents necessary and schedule a public hearing to commence <br />vacation proceedings. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Hardin, Beyer and Peterson. <br />Voting No: None. Absent: Councilmember Cich. <br /> <br />Case #13: Discussion Regarding Charges for Vacating Easements <br /> <br />Ms. Frolik noted that there is a $1,000 non-refundable fee charged for applications to vacate public <br />easements. She added that all other land use type applications require a fee and/or an escrow <br />amount. The fee is non-refundable and the escrow is used to cover costs incurred by City Staff in <br />processing the request. If there are funds remaining in the escrow accounts after an application is <br />completed, that amount is refunded to the applicant; the applicant is also responsible for any costs <br />incurred exceeding the required escrow amount. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Hardin to set a $100 filing fee <br />and a $500 escrow account for applications to vacate easements, retroactive to January 1, 1991. <br /> <br />Motion carried: Voting Yes: Mayor Gilbertson, Councilmembers Beyer, Hardin and Peterson. <br />Voting No: None. Absent: Councilmember Cich. <br /> <br />Case #14: Modification of the M.S.A.S. System <br /> <br />Mr. Jankowski stated that each year the City of Ramsey receives a substantial sum of money to <br />support its Municipal State Aid Street (MSAS) system. The amount of mileage which can be <br />designated is limited to 20% of the City's total mileage. He stated that it is advantageous to <br />designate mileage as close as possible to the maximum amount allowed. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Hardin to adopt Resolution <br />#91-04-093 establishing Municipal State Aid Highways. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Beyer, Hardin and Peterson. <br />Voting No: None.
