WHEREAS, Section 9.50.02 Subd. 5 (a) (Final Plat), Subd. 1 of the Ramsey City Code states that following approval of a preliminary plat, the applicant shall file a final plat for consideration by the City Council within one year of preliminary plat approval; and WHEREAS, Section 9.50.02 Subd. 5 (a) (Final Plat) of the Ramsey City Code further states that subsequent to the one year deadline, the applicant may request the City Council grant an extension for submission of a final plat; and WHEREAS, Section 9.50.02 (Major Plat), Subd. 8 (Recording), of the Ramsey City Code further states that within two years of the date of City Council approval of the final plat, the final plat shall be recorded at Anoka County; thereafter the City Council may extend the recording period upon written application by the subdivider; and WHEREAS, on September 29, 2006 the City received a written communication from Summerset Meadows LLC requesting a one-year extension for submittal of a final plat for the Summerset Meadows subdivision; and WHEREAS, on October 10, 2006, the City Council adopted resolution 06-10-319 that granted the applicant until October 25,2007 to submit a final plat; and WHEREAS, on September 20, 2007, the City received a written communication from the Summerset Meadows LLC requesting an additional one-year extension for submittal of a final plat for the Summerset Meadows subdivision; and WHEREAS, on October 23,2007, the City adopted Resolution #07-10-292 that granted the applicant until October 25,2008 to submit a final plat; and WHEREAS, the City received a written communication from Summerset Meadows LLC on September 2, 2008 requesting an additional two-year extension for submittal of a final plat for the Summerset Meadows subdivision; and WHEREAS, the applicant's request is based on the current challenges of the Twin Cities residential market; and WHEREAS, a two-year extension to file for final plat approval. in combination with the two-year recording time frame has the potential to postpone the project to 2012 provided no further extensions are granted to file for final plat approval or record the final plat; and WHEREAS, the City is currently working on the 2008 Comprehensive Plan update and the Subject Property may be affected by the results of that process. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: RESOLUTION #08-10-201 Page 2 of3
