That City Code Section 9.11.04 relating to home occupations states that the area set aside <br />for the home occupation in attached or detached accessory structures shall not exceed total <br />accessory building space or height allowed on the site of the home occupation, as <br />established in Section 9.11.02 of City Code. <br /> <br />6. That the Applicant currently has two accessory structures on the Subject Property which <br />total 1,980 square feet <br /> <br />7. That the Applicant is seeking to construct a 4,000 square foot accessory structure to store <br />various pieces of equipment, including equipment needed to operate a tree service <br />business on the Subject Property, which would exceed City Code requirements for total <br />square footage allowed for accessory structures by 880 square feet. <br /> <br />8. That the Applicant is currently running a home occupation as defined in City Code and <br />has applied for a home occupation permit in order to continue the operation of a business <br />on a residential parcel, pursuant to City Code Section 9.11.04. <br /> <br />9. That the Structure will meet all applicable setbacks. <br /> <br />10. That the Subject Property is not expected to be included in the Metropolitan Urban <br />Service Area (MUSA) boundary in the near future. <br /> <br />11. That the Applicant has stated the existing accessory structure will be removed upon <br />completion of the Structure. <br /> <br />12. That the proposed use will not adversely impact traffic in the area. <br /> <br />13. That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br />14. That the proposed use will not substantially adversely impair the use, enjoyment, or <br />market value of any surrounding property. <br /> <br />15. That the proposed use will not be hazardous or disturbing to existing or future <br />neighboring uses. <br /> <br />16. That the proposed use will be served adequately by public facilities and services such as <br />highways and streets. <br /> <br />17.
