That the Applicant is currently running a home occupation as defined in City Code and
has applied for a home occupation permit in order to continue the operation of a business
on a residential parcel, pursuant to City Code Section 9.11.04.

9. That the Structure will meet all applicable setbacks.

10. That the Subject Property is not expected to be included in the Metropolitan Urban
Service Area (MUSA) boundary in the near future.

11. That the Applicant has stated the existing accessory structure will be removed upon
completion of the Structure.

12. That the proposed use will not adversely impact traffic in the area.

13. That the proposed use will not be unduly dangerous or otherwise detrimental to persons
residing or working in the vicinity of the use or to the public welfare.

14. That the proposed use will not substantially adversely impair the use, enjoyment, or
market value of any surrounding property.

15. That the proposed use will be served adequately by public facilities and services such as
highways and streets.

17.
