<br />Councilmember Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #08-11-229 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF AN INTERIM USE PERMIT, TO <br />EXCEED THE TOTAL AMOUNT OF ACCESSORY STRUCTURE SQUARE <br />FOOTAGE BASED ON FINDINGS OF FACT #0837 AND DECLARING TERMS OF <br />PERMIT <br /> <br />WHEREAS, on October 22, 2008, Gene and Cindy Goede, husband and wife, (the. <br />"Permittee"), properly applied for a interim use permit for an overage in total accessory building <br />square footage established in City Code Section 9.11.02 on the property generally known as <br />17725 Baugh Street N.W. and legally described as follows: <br /> <br />The south 495 feet of the west 880 feet ofthe Southwest Quarter ofthe Northeast Quarter <br />of Section 6, Township 32, Range 25, Anoka County, Minnesota as measured at right <br />angles to the south and west lines thereof (subject to County Road No. 83 Baugh Street) <br /> <br />("Subject Property"); and, <br /> <br />WHEREAS, the Planning Commission met on November 6, 2008 and conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That based on Findings of Fact #0837, an interim use permit (the "Permit") to construct a <br />4,400 square foot accessory building, (the "Structure"), which will result in exceeding the <br />total amount square footage allowed by no more than 1280 square feet on the Subject <br />Property is hereby granted to the Permittee. <br /> <br />2. That this overage shall be allowed for a nine (9) month period from the date of approval <br />of this Permit. The Permit issued herein shall be deemed an interim use permit as <br />defined in Section 9.03.06 of City Code. Prior to expiration of this Permit, the <br />Permittee shall remove the existing accessory structure on the Subject Property and no <br />overage in accessory structure square footage shall be allowed in accordance with City <br />Code Section 9.11.02 Subd. 4. <br /> <br />3. That the City shall collect $2,000 in escrow to ensure the existing accessory structure is <br />removed in accordance with this Permit. <br /> <br />4. That the Structure shall conform to all other requirements for accessory structures. <br /> <br />5. .
