City Attorney Goodrich explained that in Section 4.5.5.2 he moved the phrase "if so
approved by unanimous vote of the sitting Council" to avoid any confusion.

There was consensus that this revision to Section 4.5.5.2 was reasonable.

Commissioner Deemer stated the last sentence in Section 4.5.5.3 needs to have the word
"year" after the word "four" to clarify the reference to a four-year term. He stated this
provision should clarify that the commencement of the four-year term does not shift as a
result of the vacancy; in other words, the four-year term that this person is taking does
not start over just because this person is filling a vacated term.

City Attorney Goodrich stated the term of this office is intended to expire on the same
date as the original term and this person is not getting a new four-year term; rather, this
person is filling the statutory, term of someone who resigned or otherwise vacated the
seat.

Chairperson LaMere read a portion of Section 4.5.1, which states: "for the remainder of
the unexpired term of the office vacated." She asked if this Section should be referenced
in Section 4.5.5.3 or if the actual wording should be included.

City Attorney Goodrich suggested adding: "the term of the office pursuant to this
subsection shall serve for the remainder of the unexpired term of the office vacated," as
stated in Section 4.5.1.

There was consensus to include this language in the proposed ordinance and forward it to
the City Council.

City Attorney Goodrich explained the Council procedure would be to hold a public
hearing on the amendments to the Charter and the Council must pass the amendments by
unanimous action; if it does, the revisions are effective 90 days from the date when
published. He stated if the amendments are not unanimously approved, there is a
statutory process for getting the amendments placed on the ballot, and these amendments
would have to be on the ballot twelve weeks ahead of the election. He added there would
be an election in November where the make-up of the Council will change; the Charter
Commission could also wait until January to present any Charter amendments to the
Council.

Motion by Commissioner Deemer and seconded by Commissioner Frederick to approve
the amendments to Sections 4.5.5.2 and 4.5.5.3.

Chairperson LaMere clarified that the last sentence of Section 4.5.5.3 shall be deleted and
replaced with the language stating that the term of the office pursuant to this subsection
shall serve for the remainder of the unexpired term of the office vacated.

Charter Commission/June 12,2008
Page 4 of5
