<br />Councilmember Olson asked if Mr. Jerdin did not retain Counsel until the day of the hearing. <br /> <br />Mr. Sliderman stated that he cannot speak to that, but the time wouldn't have been adequate <br />anyway. <br /> <br />Councilmember Look stated that since Mr. Sliderman has come in at the 11th hour, he is not <br />aware of previous conversations. He stated that he was one of the Councilmembers that led the <br />charge to give Mr. Jerdin a second chance. He stated that he understands it is an error prone <br />business and the Council very clearly communicated to Mr. Jerdin that if another error comes <br />through he would not be dealt with very favorably. He stated that Mr. Jerdin was fully aware of <br />this. He stated that the sequence of events that have happened since that Council meeting, he <br />will trust the police officers. He stated that he doesn't believe that Mr. Jerdin hasn't seen this <br />information, as indicated. He stated that the City was pretty clear at the Council meeting of <br />what the ramifications would be if a violation occurred and it is fully in Mr. Jerdin's right to <br />pursue this at a different level. He stated that the reality is that the Council, as far as he is <br />concerned, was crystal clear on what they required from Mr. Jerdin in this business and failure to <br />do so was to be met with severe ramifications. He stated that he fails to see how this can be <br />pushed off and continue to waste what has already been at least 3 hours and start over again and <br />have staff re-gather information. He stated that he thinks it is pointless. <br /> <br />Mr. Sliderman stated that the long convoluted history is why he feels that is why it is even more <br />important to allow for due process. He stated that he has never seen a license revocation hearing <br />done with 12 days notice. <br /> <br />Councilmember Look stated that the City has spent thousands of dollars on a hearing already and <br />his client was on thin ice, which there hasn't been a result from other than to say it can't happen <br />again. He stated that it has happened again and as a guardian of the City's money he feels it <br />would be irresponsible to hold another hearing on this matter. <br /> <br />Mr. Sliderman stated that. he would suggest that there is not evidence that there is cause for <br />license revocation. He stated that the timeliness of hearing is all the more reason to give due <br />process and 12 days just is not enough. <br /> <br />Mayor Gamec stated that he thinks the City has been pretty fair. He stated that at the last <br />hearing, Mr. Jerdin stated that he was up to date with his computer system and everything was <br />running fine and there shouldn't be any more violations. He read from the minutes from the May <br />27,2008 meeting. He stated that there were violations right away. He stated that the City gave <br />Mr. Jerdin an opportunity and he feels that Mr. Jerdin took advantage of the City. He stated that <br />in his opinion, contacting an attorney the day of the hearing shows a lackadaisical attitude also. <br /> <br />Mr., Sliderman stated that he cannot give away attorney/client privileges, but not everyone has <br />money, especially with the economy right now. <br /> <br />Mayor Gamec stated that the City also told Mr. Jerdin if there were problems to contact the City <br />and the City would work with him and that wasn't done. <br /> <br />Special City Council Meeting / November 18, 2008 <br />Page 17 of 19 <br />
