<br />be abated and proceed with the abatement, unless a request <br />for a hearing has been timely filed. <br /> <br />(3) The City shall, within seven (7) days after any appeal <br />period has expired or as soon as it can be reasonably <br />accomplished, have the property abated in accordance with <br />this section. <br /> <br />3. Hearing Procedure. Any property owner who feels aggrieved by an order <br />of the City Administrator or his/her designee issued pursuant to this <br />Section may request a hearing before the Hearing Examiner. <br /> <br />(a) Request <br /> <br />(1 ) Such request shall identify with specificity the basis for the <br />property owner's objection to the interpretation of City <br />Code and notice of violation. <br /> <br />(2) Such request shall be filed in writing with the office of the <br />Chief of Police within fourteen (14) days after the date of <br />the service of the notice by the City Administrator or <br />his/her designee. <br /> <br />(3) Such request shall include a filing fee as established by the <br />City's Rates and Charges. This fee will be refundable to <br />petitioner if found to be the prevailing party. <br /> <br />(b) Settlement Conference <br /> <br />(1) The Chief of Police shall schedule a settlement conference, . <br />to be conducted no more than ten (10) days after receipt of <br />the hearing request and filing fee. A later date may be <br />mutually agreed upon by the parties. The settlement <br />conference will be held between the City and the property <br />owner to encourage a resolution prior to a hearing. <br /> <br />(2) If after the conference, no resolution has been made, the <br />Chief of Police or his/her designee shall notify the Hearing <br />Examiner and the property owner of the date, time and <br />place of a hearing. <br /> <br />(c) Hearing <br /> <br />(1) A hearing shall be conducted no more than ten (10) days <br />after the Hearing Examiner receives notice of the request, <br />unless a later date is mutually agreed to by the Hearing. <br />Examiner, the property owner and the City. <br />
