<br />CASE # OL <br /> <br />PUBLIC HEARING <br />REQUEST FOR APROCEDURAL VARIANCE TO PLATTING REQUIREMENTS <br />TO ALLOW A METES AND BOUNDS SUBDIVISION; <br />CASE OF CITY OF RAMSEY <br />By: Tim Gladhill, Associate Planner <br /> <br />Background: <br /> <br />The City which is the "Applicant" for this case is in the process of acquiring parcels to construct <br />a third water tower and secure a permanent, dedicated access to Elmcrest Park, located west of <br />Saint Francis Boulevard and south of 16ih Avenue. In addition, the City has begun to assemble <br />. nearby parcels to facilitate the right of way and storm .water ponding for Quicksilver Street. <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff sent notification of the request for a variance to property <br />owners within 700 feet of the subject property. . <br /> <br />Funding Source: <br /> <br />All staff costs associated with the review of land use applications are paid for by the applicant. <br /> <br />Observations: <br /> <br />City Code prohibits the conveyance of any land described by metes and bounds, as opposed to <br />platting, with certain exceptions. The City has requested a variance to the platting requirement to <br />allow a metes and bounds subdivision, in order for the necessary right~of~way' and the water <br />tower parcels to be conveyed to the Applicant. City Code requires that this type of variance be <br />heard by the City Council, acting as the Board of Appeals. <br /> <br />If approved, the metes and bounds subdivision would create four parcels: two for the existing <br />homes on the Subject Property and two for future Quicksliver Street right~of~way andponding, <br />which the City will hold until the area is re-platted. The right~of-way will need to follow the <br />alignment of the existing water main. These two remnant parcels will not be buildable until they <br />are re-platted. <br /> <br />The existing homes are on septic systems. One concern with allowing the. metes and bounds <br />subdivision is to ensure there is sufficient space for an alternate septic she for these homes. There <br />appears to be sufficient area for a primary and secondary septic system on the existing lots of <br />record. <br /> <br />Wetland buffer requirements will still apply in this case, as new lots are being created. A <br />wetland does exi~t on Parcel A, which will be owned by the City. The wetland buffer does not <br />appear to impact the preferred alignment of Quicksilver Street and the area is anticipated to be <br />retained by the City after re~platting for storm water purposes. <br /> <br />-3- <br />
