PUBLIC BEARING ON IMPROVEMENT PROJECT #08 -32 <br />By: Steven J Jankowski, City Engineer <br />CASE # <br />Background: <br />At the May 20, 2008 Public Works Committee meeting the Committee was presented with a <br />petition signed by 54 persons representing 36 of the 67 properties benefitted by this proposed <br />project. Andrie Street and 164t Lane had been proposed for a bituminous overlay in 2008 as a <br />part of the annual street maintenance program. The petition requested that Andrie and 164 Lane <br />receive additional improvements as follows: <br />• Andrie Street and. 164 Lane be reconstructed with concrete curb and gutter to a width of <br />32 feet (one foot wider than existing width) and have a nine ton load limit: <br />• Andrie Street and 164 Lane be striped for two driving lanes and one parking lane with <br />restricted parking on the opposite street side. <br />• Failing storm water catch basins be replaced and storm sewer extended where necessary: <br />• A five foot concrete sidewalk not be installed along the north and east sides of these <br />streets. <br />City Council directed the preparation of this feasibility study on June 10, 2008 in response to this <br />petition and met with staff on three occasions thereafter to provide direction on improvements <br />and financing. <br />The petition requested that a sidewalk not be included as an element of the improvements, <br />however its absence as part of a major project such as this would be inconsistent with the <br />Comprehensive City Plan goal of achieving &walkable community. The feasibility study has <br />been prepared with a five foot concrete sidewalk being proposed as an alternate improvement <br />element. If this project . is ordered contract documents will request an alternate bid for the <br />sidewalk. The City Council will evaluate the alternate bid and decide at the time the contract is to <br />be awarded whether or not the sidewalk will be installed. If included in the project, the sidewalk <br />will vary in its distance from the back of curb to minimize impacts to desirable trees. Property <br />owners with landscape features will be contacted to discuss their salvage and restoration. <br />Retaining wall may be necessary in several locations in order to accommodate the sidewalk. A <br />copy of the feasibility study which details the specific improvements and costs is appended to <br />this case and has been mailed to all benefited property along with the legal notice of this public <br />hearing. <br />Following the public hearing, the Council should direct any revisions to the feasibility study it <br />deems necessary as a result of the comments made at the public hearing. The feasibility study, <br />will serve as the basis for determining the work to be performed and the method in which costs <br />will be financed. Unless a petition is received from a- majority of the benefited properties <br />opposing the improvement, the Council will be asked to order the projects at its March 24, 2009 <br />meeting. It is anticipated that contracts will be awarded in July of 2009 and work will be <br />performed during August and September. Final costs would be presented at the assessment <br />hearing on September 28, 2009. <br />—129-- <br />
