<br />Mr. Putnam stated MnDDT standards are often cited when discussing construction techniques <br />and standards, but he would hesitate to refer to them as an industry-wide or profession-wide <br />standard. They work in many cities throughout many states, and every city has different <br />standards. . <br /> <br />Chairperson Elvig noted the City is not asking the developer to replace all of the sidewalks. He <br />does not see this as a money issue, but more of a defense mechanism. If the City is going to <br />release the developer on their warranty they may need the $38,000 escrow for repairs atthe City <br />standard. He asked when the escrow would be returned to the developer. <br /> <br />Public Works Director Kapler replied staff is proposing to hold onto the escrow. This is <br />substandard work that did not meet the City's specifications and it is expected the sidewalks will <br />break. Staff recommends holding onto the escrow and using it as repairs are needed. <br /> <br />Councilmember Olson asked who will do the repair work if the City retains the escrow money. <br /> <br />City Engineer Jankowski replied staff would obtain quotes and retain a contractor to have the <br />work done. <br /> <br />Motion by Mayor Gamec, seconded by Chairperson Elvig, to require that Royal Oaks Realty <br />complete repairs on the sidewalks recommended by staff at the 4-inch level, with driveway <br />sidewalks that are replaced to be done at the 6-inch level, to be completed by August 1,2005. <br />The City will retain the $38,000 escrow money until one year after the completion of these <br />projects ifthe inspection is satisfactory. <br /> <br />Further discussion: Mr. Black stated there was a comment made previously about other issues <br />with this development. If there are any issues he would like to hear them. Councilmember <br />Olson stated the only reason she is not in agreement with this motion is that she does not like the <br />idea of the City taking on the responsibility beyond one year of replacing a substandard sidewalk. <br /> <br />Motion carried. Voting Yes: Chairperson Elvig and Mayor Gamec. Voting No: <br />Councilmember Olson. Absent: Councilmember Cook. <br /> <br />Chairperson Elvig informed the developer that this issue will go before the Council for <br />ratification at the first Council meeting in June. <br /> <br />Case #4: <br /> <br />Consider Traffic Control Signal Agreement with MnDOT for Signal at TH <br />47 and Xkimo Street <br /> <br />City Engineer Jankowski explained all ofthe City's seven traffic signals are maintained through <br />a joint powers agreement with MnDOT and in some cases with Anoka County and the City of <br />Anoka. The TH 47 project will include some modifications of the signals along TH 47, and <br />MnDOT is requesting that the signal agreements for these affected signals be updated.
