<br />7. That the Permittee agrees that the terms of this Variance shall be binding upon its successors <br />and assigns. <br /> <br />8. That this Variance shall automatically expire if the use is not initiated by September 2,2005, <br />and issuance of the building permit shall constitute initiation. The Permittee may petition for <br />an extension of time in which to complete the variance. Such extension shall be requested in <br />writing and filed with the City at least 30 days before the expiration of the original variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Van Scoy, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Nixt <br />Board Member Johnson <br />Board Member VanScoy <br />Board Member Brauer <br />Board Member Jeffrey <br />Board Member Shepherd <br />Board Member Watson <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />None <br /> <br />whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this <br />the 2nd day of September, 2004. <br /> <br />RESOLUTION #04-09-237 A <br />Page 2 of3 <br />
