-130— <br />And lying Westerly of the following described line: Beginning at the most <br />Northerly corner of Lot 14, said Auditors Subdivision No. 96; thence Southerly <br />along the Northwesterly line of said Lot 14 to the most Westerly corner thereof; <br />thence Southerly along Southwesterly line of said Lot 14 to its intersection with a <br />line parallel with and 150 feet Northwesterly (as measured at right angle) of the <br />Southwesterly extension of the Southeasterly line of said Lot 14; thence <br />Southwesterly along said parallel line a distance of 500 feet; thence Southwesterly <br />deflecting to right 45 degrees 00 minutes 00 seconds a distance of 900 feet, more <br />or less to the centerline of the Mississippi River and there terminating. <br />Except that part platted as Dickenson's Mississippi Estate Second Addition, said Anoka <br />County, Minnesota. <br />-or upon recording- <br />Lots 1 and Outlot A, Block 1, Michels Property <br />(the "Subject Property "); and <br />WHEREAS, on January 27, 2009, pursuant to Resolution No. 09 -01 -_, the CITY <br />approved the final plat of the Subject Property, which plat is known as Michels Property (the <br />"Plat "), which approval is contingent on certain requirements, including the DEVELOPER and <br />the CITY entering into this Agreement; and <br />WHEREAS, the final plat for the Subject Property conforms to the sketch plan; and <br />WHEREAS, the CITY requires certain improvements to be constructed within the Plat, <br />which improvements are defined as Stage I and Stage II Improvements in the City Code; and <br />WHEREAS, the DEVELOPER reaffirms the existence of an easement for roadway <br />purposes (the "Roadway Easement ") as shown on the Preliminary Plat for Jeannie and Jason <br />Michels prepared by Hakanson Anderson Associates, Inc. dated May 30, 2008, revised January <br />15, 2009, incorporated as Exhibit A (the "Exhibit A "). <br />WHEREAS, no expenditure of CITY funds will be made until the relevant City Code <br />escrow requirements have been completed by the DEVELOPER. <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br />SECTION I <br />Michels Property <br />Development Agreement <br />January 2009 <br />Page 2 of 9 <br />
