-150— Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #09- 01 -XXX RESOLUTION APPROVING CHANGE ORDER NO 1 AND THE 2 NI) PARTIAL PAYMENT TO DRYDEN EXCAVATING FOR IMPROVEMENT PROJECT #06 -30 ERMINE BOULEVARD CULVERT REPLACEMENT WHEREAS, on October 14, 2008 the Ramsey City Council adopted a resolution accepting plans and specifications and authorizing the solicitation of bids; and WHEREAS, pursuant to an advertisement for bids for IP #06 -30 Ermine Boulevard Culvert Replacement bids were received, opened and tabulated according to law on November 7, 2008; and WHEREAS, on November 10, 2008 the Ramsey City Council authorized awarding bids for IP 06 -30 Ermine Blvd Culver Replacement to Dryden Excavating Inc. and, WHEREAS, unsuitable soils where encountered and bypass flow volumes exceeded those anticipated in the bid documents, requiring a change order to compensate the contractor for these changed conditions; and, WHEREAS, City Engineer Steve Jankowski has inspected the completed work and recommends Partial Payment No 2. in the amount of $84,293.86 to Dryden Excavating Inc. which includes the compensation included in Change Order No 1. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA: That the City Council hereby authorizes that; 1) Change Order No 1 is hereby approved amending the contract with Dryden Excavating 2) Partial Payment No 2to Dryden Excavating Inc. for Improvement Project #06 -30 Ermine Boulevard Culvert Replacement in the amount of $50,768.75. 3) That the City Council hereby accepts the project and authorizes the Mayor or City Administrator to sign the release form for this payment. 4) That the total amount of this payment is not included in resolutions approving payment of bills for the date of January, 2009. 5) That the City of Ramsey Finance Department will be provided a signed copy of this resolution.
