INTRODUCE ORDINANCE AMENDING SECTION 9.22.02, SUBD. 2. <br />ESTABLISHMENT OF OFFICIAL ZONING MAP <br />By: Steven Jankowski, City Engineer <br />Background: <br />CASE # y <br />In 2006 it was brought to the attention of the City that a residence fronting on Ermine <br />Boulevard had been allowed to be constructed within the floodway of Trott Brook. After <br />a review of several courses of action to remedy this problem it was determined that the <br />replacement of the six foot diameter culvert with a larger 6 foot by 14 foot box culvert <br />was the best course of action. The existing culvert has open joints which is causing the <br />loss of material from beneath the road bed and is in need of replacement due to its <br />condition and age. <br />- A larger culvert at this location has the effect of lowering the upstream flood elevation <br />and thereby removes the Ermine Boulevard structure from the floodway. The down <br />stream flood elevation is unaffected except for a very minor increase (0.01 ft or 118 of <br />an inch) for a short distance (60ft) downstream of the culvert. (This increase is actually <br />due to better topographic information obtained at the time of the remodeling). The two <br />downstream property owners within this stretch of Trott Brook have been notified of this <br />fact in writing and staff has met with them to explain this proposed change. <br />The City received a Conditional Letter of Map Revision (CLOMR) dated September 25, <br />2008 from the Federal Emergency Management Agency (FEMA) which is attached to <br />this case. This letter states that hydraulic calculations submitted by the City have been <br />reviewed and approved by FEMA and that after the new culvert is constructed as <br />designed, FEMA will approve of a final Letter of Map Revision (LOMR). Page three of <br />this letter indentifies a number of actions to be undertaken by the City to facilitate the <br />official change of its official floodplain map. The first of these actions include the <br />adoption of the attached ordinance updating the City's Flood Plain map. <br />The City Planning Commission held a public hearing on this proposed amendment on <br />November 6, 2008. There was no public comment at that meeting and the Commission <br />recommended approval of the ordinance amendment. Also attached is a figure showing <br />the pre and post project floodplain limits. <br />Recommendation: <br />Staff recommends the introduction of Ordinance 09 -XX amending Section 9.22.02 sub. 2 <br />of City Code by adding the acknowledgement of the CLOMR letter dated September 25, <br />2008 to the Official Zoning Map. <br />-153- <br />
