Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Look, Dehen, McGlone <br />and Wise. Voting No: Councilmember Jeffrey. Absent: Councilmember Elvig. <br />Assistant City Engineer Himmer stated that he will get pricing, talk to suppliers, and <br />bring this discussion/proposed ordinance back to a work session. <br />Case #8: Consider Confirmation of Directions Given in Closed Session <br />City Attorney Goodrich stated that the Council met in special session to discuss <br />acquisition of property for the 167 Avenue project. The discussion was closed to the <br />public but there was no final action taken to report on. The second case Council <br />discussed in closed session was the attorney fee reimbursement request by Winslow <br />Holasek. Direction given in the closed meeting was to authorize payment to <br />Holasek/Hamilton in the amount of $9,693.86 claimed for attorney fees and expenses <br />contingent upon the attorneys and the landowners representing the claim signing an <br />affidavit of compliance with Minnesota Statutes 117.195 and a release of all claims <br />regarding this section signed by the landowners. <br />Motion by Mayor Ramsey and seconded by Councilmember Look to confirm the <br />direction given in the closed City Council Special meeting with regard to District Court <br />File #C801 -63 Holasek/Hamilton Attorney Fees and expenses claimed. <br />Further discussion. Councilmember Dehen stated he is not opposed to paying Holasek <br />but he is opposed to paying him without having him meet with the Attorney and <br />Administrator to go over the bills — he is opposed to paying him without due diligence. <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Look, Jeffrey, McGlone <br />and Wise. Voting No: Councilmember Dehen. Absent: Councilmember Elvig. <br />Case #9: Consider Lease with MN Renaissance School for Office Space at Old <br />Municipal Center <br />City Administrator Ulrich stated that the purpose of this case is to request Council to <br />authorize the City Attorney and the City Administrator to negotiate a lease agreement <br />according to the terms and conditions outlined in the case cover sheet distributed. This <br />would allow for two to three months of temporary occupancy of the old municipal center. <br />Motion by Councilmember Jeffrey and seconded by Mayor Ramsey to authorize the City <br />Attorney and the City Administrator to negotiate a lease agreement according to the <br />following terms and conditions: <br />• The lease would be based on a total square footage of 12,810 for the main <br />floor of old city hall and both the upper and lower levels of the old police <br />department. <br />• Lease term of two months with an optional third month at the same rate. <br />• Lease rate in the range of $5 to $7 per square foot, annually, prorated per <br />month.
