<br />3. Continuation of Conditional Use Pemlit <br /> <br />(c) Bv resolution adopt findings of fact and conclusions that support. <br />continuation of the conditional use permit. <br /> <br />(d) By motion confiml the continuation of the conditional use <br />pennit. <br /> <br />9.03.06 <br /> <br />Interim Use Permits <br /> <br />Subd. 1. Purpose. The purpose and intent of allowing interim uses is (l) to <br />allow a use for a limited period of time that reasonably utilizes the property where it is not <br />, I reasonable to utilize it in the manner provided in the comprehensive gBiaeplan; and (2) to allow a <br />use that is presently acceptable but that, with anticipated development will not be acceptable in <br />the future. <br /> <br />Subd.2. Application, Public Hearing, Notice and Procedure. The <br />application, public hearing, public notice and procedure requirements for interim use permits <br />shall be the same as those for conditional use permits as prOVIded in Section 9.03.04. <br /> <br />Subd. 3. <br /> <br />Standards for Issuance <br /> <br />a. The Planning Commission may recommend an interim use permit and the <br />Council may issue such interiin use permits only if it finds that: <br /> <br />1. . The proposed interim use meets the standards of a conditional use <br />permit set forth in Section 9.03.04 of the City Code, except as <br />specifically modified in this Section. <br /> <br />2. The proposed interim use conforms to the 'zoning performance <br />standards,. such as setbacks, heights and parking, unless a variance <br />thereto is approved by the Council. <br /> <br />3. The proposed interim use will not impose, by eminent domain, <br />additional costs 'on the public if it is necessary for the public to <br />take the property by eminent domain in the foreseeable future. <br /> <br />4. The proposed interim_use will not result in adverse effects on the <br />public health,? safety, and welfare of the residents of the City. <br /> <br />b. Every interim use permit issued shall terminate upon a date or event that <br />can be identified with certainty, with the maximum duration of five. (5) <br />years from the date of approval, unless otherwise approved by the <br />Council. <br /> <br />10 <br />
