<br />* <br /> <br />CASE #2 <br /> <br />Public Hearing <br />Proposed Ordinance to Amend Definitions of Primary Residential Garage & Home <br />Occupation in Ramsey City Code 9.02 (Definitions). <br />By: Al Haugen, Management Intern <br /> <br />Background: <br /> <br />June 16, 2008 the Home Occupation Ordinance was amended to include an administrative permitting <br />process and to relax the regulations for accessory structure home ocqupations. The current definition of <br />Primary Residential Garage needs clarification to reflect 9.11.04 (Home Occupations). <br /> <br />Notification <br /> <br />The Public Hearing to consider amendments to Chapter 9.02 (Definitions) was propefly advertised in the <br />official City newspaper. <br /> <br />Observations: <br /> <br />, , <br />The last sentence of the current definition of Primary Residential Garage was used in the past to'identify <br />attached garages as separate from the principal dwelling, for the purpose of preventing home occupations <br />from operating in attached garages on lots less than three acres in size.' Since June 16, 2008, home' <br />occupations have been permitted to operate in accessory'structure,s (including attached garages) on lots of <br />all sizes, with the issuance of a Home Occupation Permit, therefore making identification of attached <br />garages as separate from principal dwellings unnecessary. (s9.02)(99.11.04, subd.1.b.) <br /> <br />The current home occupation ordinance requires 400 square feet of an accessory structUre to be set aside <br />for storage of vehicles and equipment accessory to the primary dwelling and not related to the home <br />occupation. (99.11.04, subd.1.e) <br /> <br />The exclusion of attached garages from being, considered part of the principal dwelling is also <br />unnecessary because since June 16,2008, the area of home occupations within dwelling units have been <br />restricted to a percentage of the gross living area. Whereas the distinction of attached garages not being <br />considered part of the principal dwelling, was previously used to prevent attached garages from being <br />added to the total floor area of the dwelling. The area of home occupations, in dwelling units is now <br />based on a percentage of gross living area, not the total floor area. (99.11.04, subd.3.e. (Amended <br />, 06.16.08))(99.11.04, subd.1.c) , <br /> <br />The current definition of Home Occupation should be' updated to be consistent with the current home <br />occupation section. The current Home Occupation definition is limited to the principal structure, when <br />such operations are actually pennitted in accessory strucmres or the dwelling unit by the home <br />occupation section. (99.11.04, subd.1.b) <br /> <br />The proposed amendments to the definitions of Primary Residential Garage and Home Occupation are <br />meant to remove any conflict or confusion with the current home occupation section. (99.11.04) <br /> <br />The proposed amendments to the definition of Primary Residential Garage will remove text considering <br />attached garages to not be part of the dwelli~g unit.
