CASE #4

Discussion on Flag Pole Regulations;
By: Al Haugen, Management Intern

Background:

Flag regulations in Ramsey City Code Sections 9.11 (performance Standards) and 9.12 (Signs) are-
currently in conflict with respect t6 height limitations. In order to rectify the situation, one of these
sections must be amended.

Notification:

The Public Hearing to consider amendments to Chapter 9.02 (Definitions) was properly advertised in the
official City newspaper. _

Observations:

City Code Section 9.12.03 Subd. 11 (Flags), restricts flag pole height to twenty-five (25) feet. However,
City Code Section 9.11.11 (Permitted Encroachments) specifically excludes flag poles, among several
other types of structures, frorn any height restrictions.

One other possible option would be to simply restrict flag pole height to the maximum-.allowable building
height in a zoning district. Staff also believes that some consideration should be given to a set back
requirement for flag poles. -

Funding Source:

All costs associated with processing the City Code amendments are handled through normal staff duties.

Recommendation:

Based on discussiOli.

Commission Action:

Direct staff to bring back an amendment to City Code related to flag pole height restrictions.

Review Checklist:

Community Development Director
Associate Planner
Environmental Coordinator

PC: 02/05/2009

Attachments:
Attachment A: Ramsey City Code restricting flag height (99.12.03 subd. 11 & 99.11.11).

27
