Case # 1

Public Hearing .
CONSIDER AMENDMENT TO CITY CODE CHAPTER 9.03 (ADMINISTRATION) RELATED
TO ENFORCEMENT OF CONDITIONAL AND INTERIM USE PERMITS;
CASE OF THE CITY OF RAMSEY
By: Tim Gladhill, Associate Planner

Background:

City Code currently states that the only recourse of action for a violation of a conditional or interim use
_ permit is to tevoke the permit. Recent discussions have suggested that suspension of the permit may be a
better solution in certain circumstances.

Notification:

The Public Hearing was properly advertised in the official newspaper of the City. No notifications were
sent via mail.

Observations:

Attached for your review is an amendment to City Code to allow for suspensions of conditional and
interim use pennits. The proposed amendment allows for the City to schedule a Public Hearing following
a 30 Day Notice of Violation of terms of a conditiomil or interim use permit. At that Public Hearing, the
City- Council can move to suspend or continue the permit, or decide to schedule revocation hearings as
currently provided in City Code.

Funding Source:

Amendments to City Code are handled through nonnal staff duties.

. Recommendation:

Staff recommends approval of Ordinance #09-_ amending City Code Section 9.03 (Administration)

Reviewed By:

Management Intern

PC: 02/05/2009

Attachments:
Attachment A: Proposed Amendment to City Code Chapter 9.03 (Administration)

1
