Councilmember Dehen stated that he has concerns, <br />because he knows some of the businesses may, although aware of the fact that the City has <br />pavement requirements, not comply with the ordinance because it was not being enforced <br />uniformly. He stated that this speaks to Councilmember Look's point because that has been a <br />signal to not apply tins uniformly because the north side of Highway 10 is being bought up by <br />RALF and the thought that the City didn't want to acquire blacktop because it will raise the cost. <br />He stated that he is not necessarily in agreement with allowing compliance to be lax on <br />everything that is existing because that sends the wrong message. He stated that people can <br />request variances, when necessary. Mayor Gamec stated that he thinks that this type of situation <br />recently happened with Minndak. Councilmember Elvig stated that he supports this because it <br />gets half of it accomplished. He stated that there is still the issue of handling existing properties <br />along Highway 10 and the new Council can take a look at that. Councilmember Strommen <br />stated that perhaps the Council needs to review this and make a decision on grandfathering <br />properties. Councilmember Look stated that the Council understands that it has not resolved the <br />grandfathering issue, but if this is just a housekeeping issue for new developments coming in, he <br />is okay with that. He stated that he does not think the Council can come up with grandfathering <br />decisions tonight. City Attorney Goodrich stated that he thinks the ideas should be returned to <br />staff because these are technical issues. Keith Kiefer, 6203 Rivland Avenue NW, stated that <br />there are a few things that need to be considered. He stated that if the issue is. dust, it can be <br />handled with public or private nuisance on a case-by-case basis. He stated that with the <br />economic situation as it is, to put additional controls on struggling businesses now would create a <br />problem. He stated that if the City requires more impervious surface, it seems self-serving <br />because it creates more tax revenue. He stated that dust can be handled without more impervious <br />surfaces, such as rain gardens, which do not impact the ground water. He stated that in Carlsbad, <br />they paved the parking lot, which is adversely impacting the caverns and ground water. <br />Councilmember Elvig stated that he appreciates his comments because there is a balance of good <br />and bad with blacktopping. Councilmember Dehen stated that he would like to ask if <br />Councilmember Look would be willing to withdraw his motion to table discussion to see what <br />needs to be done with enforcement. Councilmember Elvig suggested that staff come back with <br />language for enforcement that does not injure existing businesses and move this forward tonight <br />for new projects. <br /> <br />Councilmember Look rescinded his original motion. Councilmember Elvig rescinded his <br />second. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Look, to table discussion of the <br />Ordinance to Amend Performance Standards in the E-l and E-2 Employment Districts; Case of <br />City of Ramsey, to allow staff to bring back options for enforcement on existing businesses. <br /> <br />Motion canied. Voting Yes: Mayor Gamec, Councilmembers Elvig, Look, Dehen, Olson, and <br />Strommen. Voting No: None.
