<br />CONSENT # ~ <br /> <br />CONSIDER APPROVAL OF <br />SUNFISH EXPRESS, INC. <br />TOBACCO AND LIQUOR VIOLATION <br />SETTLEMENT AGREEMENTS <br /> <br />By: William K. Goodrich, City Attorney <br /> <br />Background: <br /> <br />Sunfish Express, Inc. ("Sunfish") received two administrative citations from the City for selling <br />tobacco to a minor on October 2, 2008 and selling alcohol to a minor on November 11, 2008. <br />Initially, Sunfish requested a hearing to contest the charges and staff had scheduled contested <br />hearings on February 3,2009 with the City Council as the hearing examiner. However, prior to <br />the hearing, Mr. Yamoutpout, on behalf of Sunfish, and the City's Police Chief spoke and <br />reached a settlement agreement. As you know, the contested hearings were therefore cancelled <br />and we are now presenting the settlement agreements for City Council approval. Please note the <br />civil fines and the alcohol one (1) day suspension are mandatory minimums. <br /> <br />Funding Source: <br /> <br />None required. <br /> <br />Staff Recommendation: <br /> <br />Approve each of the Settlement Agreements. <br /> <br />Council Action: <br /> <br />1. Motion to approve the Settlement Agreement for the Sunfish Express, Inc. tobacco <br />violation occurring on October 2,2008, being City Case No. 238992. <br /> <br />2.
