Update: <br /> <br />At the request of Mr. Guimont and his attorney, this case was rescheduled for the Fire <br />Board meeting of November 20, 1991. Additional information supporting the claim of <br />lost wages was to be forwarded. No further information has been received. <br /> <br />Observations: <br /> <br />Since December of 1990, the fire fighters requested, and the City Council funded, a <br />different disability plan for fire fighters. Under this plan, a firefighter will receive <br />$433.33 (non-taxable) per month in addition to workers' compensation. This benefit is <br />a constant and does not vary with pre-injury earnings. <br /> <br />In addition, it is my understanding the fire fighters have added another disability plan <br />that is not City funded. This plan, if the firefighter participates, would pay $35/day <br />up to a maximum of $7,000.00 <br /> <br />Mr. Guimont is now requesting the City pay him benefits under the above two plans <br />rather than the proposed plan in December of 1990. The benefit value of these two <br />plans would be $1,483 per month for approximately seven months and $433 per month <br />thereafter. <br /> <br />As Mr. Guimont has not responded to our request for information, the period of time <br />for which he is requesting these additional benefits is not clear. <br /> <br />Recommendation: <br /> <br />It is most difficult to determine benefits based on what might have happened, and for <br />this reason estimating earnings for the weeks remaining after injury at the same rate <br />as pre-injury is a reasonable determination. While this method results in no <br />additional benefit dollars to Mr. Guimont, it does reasonably determine if the workers' <br />compensation rate is the same as or exceeds the income level at the time of injury. In <br />Mr. Guimont's case the workers' compensation rate does exceed his pre-injury income <br />level, and for this reason, my recommendation is that no additional benefits are due <br />to Mr. Guimont. <br /> <br />As to Mr. Guimont's request for benefits under the current plans, our former Council's <br />action is of record and disability benefits were to be determined based upon the <br />proposed plan in December of 1990. My recommendation above is consistent with this <br />action. <br /> <br />Fire Board Action: <br /> <br />Motion to recommend to Council that no additional disability benefits are due to Mr. <br />Jay Guimont as a result of injury on October 21, 1990 while serving as a Ramsey <br />Firefighter. <br />or <br />Motion to recommend to Council that additional disability benefits <br />are due to Mr. Jay Guimont as a result of injury on October 21, 1990 while serving as <br />a Ramsey Fire fighter. <br /> <br />Review Checklist: <br /> <br />Finance Officer <br />City Administrator <br />Personnel Coordinator <br />Mr. Jay Guimont (copy of this case mailed) <br /> <br />FB: 11/20/91 <br /> <br /> <br />
