The following within the City are excluded from this Interim Ordinance: 1. None. SECTION 6. UNDUE HARDSHIP EXCEPTIONS The City Council may grant an exception to the provisions of this Ordinance when, in its opinion; the City Council shall undue hardship may result form strict compliance. In granting an exception, prescribe any conditions that it deems necessary to, or desirable for, the protection of the public interest. NO exception shall be granted unless the City Council finds: 1. That there are special circumstances or conditions affecting said property such that the strict application of the provisions of this Interim Ordinance would deprive the petitioner of the reasonable use of petitioner's land. 2. That the exception is necessary .for the preservation and enjoyment- of a substantial property right of the petitioner. 3. That the granting of the exception will not be detrimental to the public welfare or injurious to other property in the area in which the property is situated. 4, That the proposed exception will be harmonious with -and in accordance with the specific objectives of the City's existing Comprehensive Plan and will not adversely affect the planning process for adoption of amendments Io the Comprehensive Plan above described. 5, That the proposed use will be consistent with the intent and purpose of this Ordinance. SECTION 7. TERM The term of this Ordinance shall be for a period of six (6) months. commencing with its effective date. The term may be extended after approval by the City Council for an additional period as provided for in Minnesota Statutes, Section 462.355, Subd. 4. SECTION 8. PENALTIES An person,-firm, entity or corporation that undertakes any development actubtect to ana additional Y provisions of this Ordinance shall be guilty of a misdemeanor and shall e s ~ Y legal or equitable remedies available to the City.
