Mr. Enstrom cautioned the City regarduig overgrowth of weeds and residents claiming it is a <br />prairie yard. <br />Environmental Coordinator Anderson stated there is a provision in the City Code regarding wild <br />flowers and native grasses that addresses a resident's ability to establish their yard with prairie <br />flowers and/or native grasses; the Code requires a management plan to ensure it does not create a <br />nuisance for adjoining property owners. <br />Chairperson Nixt directed staff to continue to evaluate the proposed ordinance to take into <br />account the comments received this evening without unnecessarily delaying its passage by the <br />City Council, <br />Assistant- City Engineer Himmer stated the proposed ordinance will be presented to -the- City <br />,Council on January 13, 2009, which allows staff sufficient time to work on further revisions. <br />Motion by Com~.nissioner Brauer, seconded by Commissioner Levine, to recommend that City <br />Council adopt an ordinance amending Sections 9.02 (Definitions),-9.11 (Performance Standards), <br />9.20 (Zoning Districts), and 9.50 (Subdivision) establishing a topsoil requirement, contingent <br />upon staff working with local expert(s) to further refine the ordinance based on comments <br />received at tonight's public hearing. <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Brauer, Levine, and Van Scoy. <br />Voting No: Norie.
