Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #09-02-XXX RESOLUTION TERMINATING IMPROVEMENT PROJECT #08-31 -THE BITUMINOUS PAVING OF CHAMELEON STREET IN THE SHAWN ACRES SUBDIVISION WHEREAS, pursuant to a motion of the Ramsey City Council on May 27, 2008 ; a feasibility study has been prepared by Steve Jankowski, City Engineer, Improvement Project#08-31 -The Bituminous Paving of Chameleon Street in The Shawn Acres Subdivision; and WHEREAS, a resolution of City Council adopted on Octoberl4, 2008 fixed a date for a Council hearing on the proposed improvement; and WHEREAS, ten days' mailed notice and two weeks published notice of the hearing was given, and the public hearing was held thereon on the 10th day of November, 2008, at which all persons desiring to be heard were given an opportunity to be heard thereon; and, WHEREAS, a petition opposing IP #08-31 has been received which has been signed by more than 50% of the benefitted property owners; and WHEREAS, 30 days has elapsed since the receipt of the opposing petition without the .receipt of a counterpetition favoring the project. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That IP #08-31 is hereby terminated and a similar project shall not be considered within twelve months of the date of this resolution The motion for the adoption of the foregoing resolution was duly seconded by Councilmember and upon~vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the following abstained: and the following were absent: where upon said resolution was declared duly passed and adopted by the Ramsey City Council this the 24th day of February 2009.
