City of West Lafayette, 896 N.E.2d 1218 (Ind. Ct. <br />App. 2008) <br /> <br />INDIANA (12/02/08)-The city had an ordinance (the "Ordi- <br />nance") that restricted the number of tenants in .rental housing to a <br />maximum occupancy of three unrelated persons. The Ordinance pro- <br />vided that it was "the continuing duty of the owner [of rental prop- <br />erty] to personally monitor the occupancy of each dwelling unit and <br />to ensure that it [wa]s not occupied by more persons than the maxi- <br />mum allowable occupancy."
