Town of Windham, 2008 WL 5245564 (N.H. 2008) <br /> <br />NEW HAMPSHIRE (12/18/08)-Andrew and Christine Lane resided <br />on property in the town. In 2003, they sought to construct a detached <br />garage on a portion of the property. They obtained a building permit and <br />began construction. <br />Subsequently, abutting property owners, William Schroeder aild A1 Let- <br />izio, Jr. challenged the town's decision to allow the Lanes to construct the <br />garage. They filed an appeal with the town's Zoning Board of Adjustment <br />(the "ZBA"). They argued that because the garage fell within the town's <br />Wetlands and Watershed Protection overlay district (the "WWPD"), its <br />construction was prohibited and in violation of the town ordinance. <br />the ZBA agreed with Schroeder and Letizio.
