Absent: None. <br /> <br />COUNCIL BUSINESS <br /> <br />Case #1: <br /> <br />Request for Final Plat Review of Michels Property (6080 Highway #10 NW); <br />Case of Jeannie Michels <br /> <br />Associate Planner Gladhill explained that the applicant has submitted a final plat application to <br />re-plat two parcels and separate the existing commercial use from the larger, undeveloped parcel; <br />the property is located south of Highway 10 at the border of the cities of Ramsey and Anoka. He <br />stated that no public hearing is required for a minor plat; however, the City Council adopted a <br />policy requiring notification of a proposed subdivision be sent to residents within 350 feet of the <br />property during sketch plan submittal. He stated if the proposed plat is approved, Outlot A <br />would continue to have a dual zoning designation and no comprehensive plan amendment or <br />zoning amendment is being proposed at this time because the owner is not sure what they intend <br />to do with the property at this time. He noted that a portion of Outlot A is within the Mississippi <br />River Critical Area Overlay District and staff has forwarded the request to the DNR for <br />comment. He stated staff has also forwarded the request to the Minnesota Department of <br />Transportation and MnlDOT has replied that the proposed plat should have little impact on its <br />transportation system or right of way. He indicated that no connections to municipal services are <br />being proposed at this time and the current facilities on Lot 1 are served by private well and <br />septic. <br /> <br />Associate Planner Gladhill further explained that there has been significant discussion regarding <br />the easement for road purposes on the proposed Outlot. He stated the applicant was originally <br />proposing to vacate the existing road easement leading to King's Island; this easement was <br />originally intended to construct a road to parcels along the river on King's Island. He indicated <br />the applicant has now revised the application and is not requesting vacating the easement for <br />roadway purposes and staff is requesting that the existence of the easement be reaffirmed by the <br />applicant through the resolution adopting the final plat and development agreement. He stated if <br />there is a proposal to subdivide Outlot A in the future, a secondary access separate from Rivlyn <br />Avenue will need to be addressed at that time. He added there are currently four accessory <br />structures on the proposed Outlot A; the applicant would like to allow these structures to remain <br />on the property until redevelopment occurs. He stated staff is generally amenable to this request, <br />with an agreement stating that the structure will be removed at such time as the City begins <br />constructing a trail through the easement in the Development Agreement; no additional <br />structures will be allowed to be built until the area is platted. <br /> <br />Councilmember McGlone stated it was brought to his attention that there may be an issue with <br />zoning and the requirement for a 60 foot buffer between Eland residential. <br /> <br />Associate Planner Gladhill stated the buffer would come into play if the applicant were <br />requesting to plat Outlot A as a buildable lot. <br /> <br />City Council/January 27, 2009 <br />Page 5 of 20 <br />
