<br />Wise expressed concern that the City would be spending money to market a building that is not <br />very marketable. Councilmember Jeffrey concurred and added if the property sits vacant for too <br />long, there is a chance for vandalism. Economic Development Coordinator Sullivan stated that <br />the City has hired Premier Commercial Properties to maintain and market those properties the <br />City purchased on Highway 10. He added the City pays $200 to $400 per unit to maintain these <br />properties; Premier will market and fill tenants for the City and the City pays Premier $400 per <br />month on this particular property. He requested clarification from the City Council on whether <br />Premier should market this property as a mercantile (M) use. Mayor Ramsey stated the property <br />should be marketed as a mercantile (M) use. Councilmember Elvig stated he was in agreement <br />with the direction on this matter, but requested further discussion by the Council at a work <br />session regarding use of RALF funds. <br /> <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Dehen, Elvig, Jeffrey, Look, <br />McGlone, and Wise. Voting No: None. Absent: None. <br /> <br />Case #3: <br /> <br />Consider Change Order No 1 and Partial Pay Estimate No.2 for Ermine <br />Boulevard Culvert Replacement IP 06-30 <br /> <br />City Engineer Jankowski stated this project replaces a six-foot diameter round concrete culvert <br />which transmits flow from Trott Brook beneath Ermine Boulevard with a larger six foot by <br />fourteen foot box culvert located several hundred feet west of the intersection with Ermine <br />Boulevard. He noted the existing culvert had open joints, which was causing the loss of material <br />from under the roadbed. He added the larger culvert will lower the upstream 100-year flood <br />elevation; as a consequence, a residence constructed in 1987 will no longer be within the flood <br />plain. He stated it was originally anticipated that poor soils would have been removed when the <br />existing culvert was constructed in the early 1970's; however, organic soils unsuitable for a <br />structural foundation were encountered up to eight feet below the bottom of the replacement <br />culvert. He noted that it was necessary to direct the contractor to perform additional work to <br />install this culvert and Change Order No. 1 is intended to compensate the contractor for this <br />additional work, which included the removal of the unsuitable material and its replacement with <br />good granular backfill beneath the base of the culvert. He indicated it was also necessary to <br />dewater for this depth of excavation. He added due to the wet autumn preceding this project, the <br />flow through a temporary bypass culvert was greater than the 12" pipe could handle and a larger <br />24" bypass pipe was needed. He stated staff has verified the trip tickets associated with the <br />project and is satisfied that they are reasonable. <br /> <br />Councilmember Dehen asked how the City protects itself from unforeseen consequences and <br />whether there was anything that could have been done to avoid this expense. <br /> <br />City Engineer Jankowski replied if borings had been done around the culvert prior to the project, <br />the City could have anticipated that. He noted that dewatering would still have been necessary <br />but it was difficult to know the extent of the materials in there. <br /> <br />Councilmember Dehen asked if this is the only area where this culvert could be placed. <br /> <br />City Council / January 27, 2009 <br />Page 8 of 20 <br />
