COMMISSION BUSINESS <br /> <br />Case #1: Request for a Variance from Front Yard Setback Requirements; Case <br /> of Patrick Boedigheimer <br /> <br />Ms. Frolik stated that Mr. Boedigheimer is proposing to construct a 672 square foot garage on his <br />property located at 7944 - 142nd Avenue N.W. The principal structure is located approximately <br />305 feet from the front property line. Mr. Boedigheimer is proposing to locate the new structure in <br />the west side yard, but closer to the front property line than the principal structure to avoid building <br />the structure on the slope to the river and encroaching on natural drainage area. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Bawden to adopt Findings of <br />Fact #0297 relating to Mr. Patrick Boedigheimer's request for a variance from front yard set back <br />requirements. <br /> <br />Motion carried. Voting Yes: Chairman Hendriksen, Commissioners Deemer, Bawden, Thorud <br />and Zimmerman. Voting No: None. Absent: Commissioners LaDue and Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Bawden to amend #1 in the <br />Conditional Use Permit to read 265 feet from the front property line, not 275. <br /> <br />Further discussion: Mr. Boedigheimer expressed concern with 265 feet and requested that the <br />variance specify 260 feet because his measurements may not be accurate. <br /> <br />Commissioner Deemer and Commissioner Bawden withdrew their motion. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Zimmerman to amend #1 to <br />read "The accessory structure shall be placed so the rear wall is no more than 15 feet from the front <br />wall of the house". <br /> <br />Motion carried. Voting Yes: Chairman Hendriksen, Commissioners Deemer, Zimmerman, <br />Bawden and Thorud. Voting No: None. Absent: Commissioners LaDue and Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Thorud to modify #3 to read <br />"The accessory structure shall not exceed 672 square feet and be 24' x 28' as illustrated on the <br />survey. <br /> <br />Commissioner Zimmerman asked Mr. Boedigheimer if he was in agreement with the conditions, to <br />which Mr. Boedigheimer answered that he was. <br /> <br />Motion carried. Voting Yes: Chairman Hendriksen, Commissioners Deemer, Thorud, Bawden <br />and Zimmerman. Voting No: None. Absent: Commissioners LaDue and Terry. <br /> <br />Motion by Commissioner Thorud and seconded by Commissioner Deemer to approve Mr. Patrick <br />Boedigheimer's request, as amended, for a variance from front yard set back requirements. <br /> <br />Motion carried. Voting Yes: Chairman Hendriksen, Commissioners Thorud, Deemer, Bawden <br />and Zimmerman. Voting No: None.
