Absent: Commissioners Brauer, Cleveland, and Van Scoy. <br /> <br />NOTE CITY COUNCIL MINUTES <br /> <br />The following Council minutes were noted: <br /> <br />1) City Council regular meeting minutes dated November 25,2008 <br />2) City Council regular meeting minutes dated December 9, 2008 <br />3) City Council regular meeting minutes dated January 13,2009 <br /> <br />PUBLIC HEARINGS/COMMISSION BUSINESS <br /> <br />Case #1: <br /> <br />Public Hearing - Consider Amendment to City Code Chapter 9.03 <br />(Administration) Related to Enforcement of Conditional and Interim Use <br />Permits; Case of City of Ramsey <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 7:03 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearine: <br /> <br />Chairperson Nixt called the public hearing to order at 7:03 p.m. <br /> <br />Presentation <br /> <br />Associate Planner Gladhill stated City Code currently states that the only recourse for violation <br />of a conditional or interim use permit is to revoke the permit; recent discussions have suggested <br />that suspension of the permit for a specified period of time may be a more appropriate solution <br />rather than requiring the applicant to go through the permit process again. He presented the <br />proposed amendment to Chapter 9.03.05, subd. 9, which outlines the procedure for suspension of <br />conditional use permits and stated the property owner is given 30 days in which to submit a <br />written response to the possible violation, followed by a public hearing conducted by the City <br />Council. He explained at that time, the City Council can choose to suspend or continue the <br />permit as is. He noted that this provision is restated in Section 9.03.06 for interim use permits <br />and would follow the same procedure as conditional use permits. <br /> <br />Commissioner Brauer arrived at 7:05 p.m. <br /> <br />Citizen Input <br /> <br />None. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Rogers, to close the public hearing. <br /> <br />Planning CommissionlFebruary 5, 2009 <br />Page 2 of 10 <br />
