. 4 9 74 2 3 . 0 0 2 111111111111111111111111111111111111111111111 Record 10 2182048 REC'O M,L\R 11 2009 Councilmember Look introduced the following resolution and moved for its adoption: RESOLUTION #08-10-203 A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT #0833 AND DECLARING TERMS OF PERMIT AND TO EXCEED SIGN SIZE AND HEIGHT RESTRICTIONS AS ESTABLISHED IN CITY CODE. WHEREAS, Schad Tracy Signs properly applied for a conditional use permit to exceed sign size, number, and height restrictions as established in City Code on the property generally known as 7900 Sunwood Drive and legally described as follows: Lot 1, Block 1, Ramsey Town Center 3rd Addition, Anoka County, Minnesota ("Subject Property") WHEREAS, the Planning Commission met on May 1, 2008, conducted a public hearing, and recommended that City Council approve the request. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: ~; 1. Based on Findings of Fact #0833, a conditional use pemiit ("Permit") to exceed sign size, number, and height restrictions is hereby granted to Schad Tracy Signs ("Permittee"). 2. The Permittee is herein granted permission to erect one pylon, ground sign in addition to the existing ground sign used to advertise the price of gasoline, on the Subject Property. 3. The gross surface area of the free standing ground sign shall not exceed 285"square feet p'er face. The height ofthis sign shall not exceed thirty-five (35) feet. ""', 4. The installation of the signs on the Subject Property shall require a sign permit from the City of Ramsey. The exact location of the sign is subject to the approval of both the City and Connexus Energy. Footings for each sign must be sized by a licensed engineer. 5. The signs shall be properly constructed and maintained in accordance with Section 9.12.12 (Construction Specifications) & 9.20.25 (Town Center District) Subd. 7 (Signage) of the Ramsey City Code. 6. That the Permittee shall be responsible for all City costs incurred in administering and enforcing this Conditional Use Permit. 7. That the City Administrator, or his/her designee, shall have the right to inspect the premises for compliance and safety purposes annually or at any time, upon reasonable request. 8. That if any provision of this Permit shall be declared void or unenforceable, the other provisions shall not be affected but shall remain in full force and effect.
