<br />COUNCIL BUSINESS <br /> <br />Case #2: <br /> <br />Ramsey Town Center Lawsuit - City of Ramsey vs. Minnwest Bank <br /> <br />Tom Bray, counsel with Briggs and Morgan, requested the City Council close this portion of the <br />special meeting to the public based on attorney-client privilege. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Look, to close the special <br />meeting of the City Council to the public based on attorney-client privilege. <br /> <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Elvig, Look, Dehen, Jeffrey, <br />McGlone, and Wise. Voting No: None. Absent: None. <br /> <br />The closed session ended at 6:43 p.m. <br /> <br />Case #1: <br /> <br />Consider Acquisition of Property Located at 6401 Highway #10 NW (Sunfish <br />Express) <br /> <br />City Administrator Ulrich stated he invited the property owner to attend tonight's meeting in <br />case the Council has any questions. <br /> <br />Motion by Councilmember Look, seconded by Councilmember Dehen, to re-open the special <br />meeting of the City Council. <br /> <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Look, Dehen, Elvig, Jeffrey, <br />McGlone, and Wise. Voting No: None. Absent: None. <br /> <br />Mayor Ramsey re-opened the special meeting of the City Council to the public at 6:43p.m. <br /> <br />Frank Yamoutpour, owner of Sunfish Express, appeared before the City Council and stated he <br />has talked to City Administrator Ulrich about the possibility of the City buying him out because <br />it is impossible for him to run his business. He added he is ready to negotiate with the City. <br /> <br />Mayor Ramsey asked Mr. Yamoutpour if he has moved toward suing the County. <br /> <br />Mr. Yamoutpour stated he has not yet, and added he has asked for a hearing from the County but <br />to date, nothing has happened. <br /> <br />Councilmember Dehen stated if any entity is going to purchase the property, it would be through <br />RALF and it was his understanding there are no RALF monies available right now. He stated he <br />was not comfortable putting the residents of Ramsey at risk to buyout this property outside the <br />RALF program. <br /> <br />City Attorney Goodrich stated the City Council can close the meeting pursuant to Minnesota <br />Statutes Section 13D.05, in order to discuss the property at 6401 Highway #10 NW (Sunfish <br />Express Shell Station). <br /> <br />Special City Council Meeting/January 27, 2009 <br />Page 2 of3 <br />
