<br />.. <br /> <br />32 <br /> <br />Subd. 1. Identification and Delineation of Wetlands. <br /> <br />a. <br /> <br />This Section shall apply to all land containing wetlands and land <br />within the setback and buffer areas as defined herein. Wetlands <br />shall be subject to the requirements established herein, as well as <br />restrictions and requirements established by other applicable <br />Federal, State, and Local regulations. These wetland protection <br />regulations shall not be construed to allow anything otherwise <br />prohibited in the zoning district where the wetland area is located. <br /> <br />b. <br /> <br />A wetland is land that meets the definition of "wetlands" set forth <br />in Section 9.02 of this Chapter. It is the responsibility of an <br />applicant to delineate the wetland boundary or to determine that no <br />wetland exists on a subject property. All delineations must be <br />approved by the LGU. Wetland delineations supplied by <br />applicants shall be certified by a qualified wetland delineator. <br />Wetland delineators must satisfy any certification requirements <br />that may be established by the U.S. Army Corps of Engineers or <br />the Minnesota Board of Water and Soil Resources. <br /> <br />c. <br /> <br />Wetlands have been or will be identified and the management <br />classification of the wetland, as established by the m~nicipal <br />wetland management classification map adopted by the City <br />Council, shall be 'prima facie evidence of the location and <br />management classification of a wetland. The municipal wetland <br />management classification map shall be developed and maintained <br />by the City's Community Development Department and is open to <br />inspection by the public. <br /> <br />The absence of a wetland on the municipal wetland management <br />classification map or the National Wetland Inventory does not <br />represent a definitive determination as to whether a wetland <br />covered by this Section is or is not present. Wetlands that are <br />identified during site specific delineation activities but do not <br />appear on the municipal wetland management classification map <br />are still subject to the provisions of this Section. It is the <br />applicant's responsibility to supply detailed infonnation to <br />determine the management classification of a wetland that does not <br />appear on the municipal wetland management classification map. <br />The municipal wetland management classification map will <br />subsequently be amended to reflect this information. <br /> <br />d. <br /> <br />The four wetland management classifications established in this <br />Section are Preserve, Manage 1, Manage 2 and Manage 3 <br />wetlands, defined as follows: <br />
